can a wedding dress shop order the wrong size dress and then charge to fix it?

Hi, I've just bought a wedding dress shop and they ordered a size too large and wanted to charge $400 to fix it, I've managed to get the price down to $300 and working on them bringing it down to $200 which I probably would have had to pay in alterations anyway. My wedding is only 5 weeks away. I'm so upset, she measured me so why order the wrong size. She said she did it because it was the only size in stock to order but if I'd known about the additional charge and that the dress would be too big I may have gone elsewhere or chosen a different dress. I really think she should bring it down a size for free. Has anybody else had this problem?

When you say that you have just bought a wedding dress, I take it that you have paid for it without actually seeing the wedding dress, just perhaps a picture? Or one that was in the shop that you liked. Did you try a dress on? No. Oh dear!!!
However, this does not solve your problem. The simple answer is NO, they are not entitled to order a larger size dress than you asked for and then expect you to pay for the alterations. I don't know how the law works in your country but I can imagine it is similar to English law ie; if an article you purchased does not comply to your order, the seller must either replace it, make the necessary alterations (without charge to purchaser) or refund all money paid. If the seller does not comply they can be reported to the Trading Standards Office, or some such organisation which you may have in your country. Approach the shop owner and explain that unless they alter the dress free of charge and delivered on time or fully refund your money, you intend to take the matter to such an authority.
